Cross Border Transactions in Worldwide Economy: A Legal Perspective

Aug 2026 · International Journal of Law Management & Humanities · 0 citations · 3 references

Abstract

Cross-border transactions have become an essential part of the global economy because of their capacity to facilitate international trade, foreign investment, capital movement and economic integration among States. The growing complexity of international business operations has nonetheless produced serious legal difficulties, arising from variations in national laws, regulatory frameworks, taxation systems, foreign exchange controls, jurisdiction and dispute-resolution procedures. This study examines the legal framework governing cross-border transactions and analyses the significance of international treaties, conventions and organisations in promoting stable and secure international trade. It assesses the principal international agreements governing commercial dealings and dispute settlement, together with the role of the World Trade Organization in regulating cross-border trade. The study also offers a comparative legal analysis of China, Singapore, India, the United States and the United Kingdom, emphasising the differences in their regulatory strategies and in the machinery each provides for enabling cross-border transactions. Contractual matters, foreign investment, taxation, enforcement and international arbitration receive particular consideration. The study further analyses the main legal problems that cross-border enterprises face and examines potential responses through international cooperation, regulatory harmonisation and efficient dispute-resolution procedures. It concludes by evaluating India's place in the international trading system and recommending ways to streamline regulatory processes, increase legal certainty and enhance institutional coordination. The argument advanced is that encouraging sustainable cross-border trade, while defending legitimate national and economic interests, requires a fair and internationally compatible legal system.
