Modern energy legislation of Ukraine in the conditions of sustainable development: main problems and prospects for development
Abstract
The article conducts a comprehensive study of national energy legislation, taking into account the current challenges and threats of a political, military and socio-economic nature that Ukraine faces, and the need to achieve the generally recognized goals of sustainable development. It is noted that today energy and energy, energy relations in our state are the subject of special attention from national authorities, along with such important tasks as effective counteraction to the Russian Federation as an aggressor country, the implementation of an effective, targeted international policy, military and, in the future, post-war restoration of Ukraine, etc. It is emphasized that all these tasks are closely interconnected, which significantly affects the formation and development of domestic legislation in the energy sector. Based on the analysis of a number of national regulatory legal acts, it is argued that in general the concept of sustainable development is quite fully reflected and enshrined in the legal framework of Ukraine. This concerns the regulation of such energy relations as: intensification of the energy transition, including an increase in the share of renewable energy sources, increasing energy efficiency, encouraging investments in domestic energy infrastructure and investments in clean energy technologies, modernization and development of technologies for modern and sustainable energy supply, strengthening energy security as a component of Ukraine’s national security, international cooperation in the energy sector. It is concluded that the regulation of the energy sector by several dozen regulatory acts has both positive (versatility and multifacetedness of the legal regulation of the domestic energy sector) and negative consequences. Among the latter are potential risks of inconsistencies, discrepancies, and even direct contradictions in the texts of various documents. It is emphasized that this can lead to difficulties in their understanding, scientific understanding, research, as well as in the application of relevant provisions in practice. Additionally, the proposal regarding the need to codify modern energy legislation of Ukraine is substantiated and supported.
