Human biological nature, fetal crimes, the latest biomedical technologies: challenges of reality and their criminal law regulation in the Republic of Armenia

Abstract

This article examines the current challenges of reality related to the development of the latest biomedical technologies in the context of their criminal law regulation. In the context of the development of fetal cosmetology, special attention is paid to illegal encroachments in the reproductive sphere, aimed at the further misuse of embryos. Conducting scientific and medical experiments on humans without their consent, the possibility of interfering with the human genotype and its natural development and evolution, illegal acts with human embryos, the emergence of new types of criminal exploitation, including reproductive exploitation – issues that are at the intersection of law and morality, raising the question of human dignity and in need of detailed criminal law regulation. Based on the analysis of existing crimes and the analysis of potential threats in the field of biomedical ethics and the reproductive sphere, the article presents proposals aimed at improving criminal legislation.
